Updated Guidance - Right to Rent Checks

We have been advised of new guidance being implemented on 25th November 2020 regarding Right to Rent regulations for applicants wanting to rent residential premises in England.
CURRENT RIGHT TO RENT CHECK PROCESS
At present, the regulations stipulate that new applicants must be checked to ensure they have the Right to Rent a property in England. This check is usually done by evidence of their passport or driving licence; however, for non-UK nationals in England, they would need to supply a visa or biometric resident permit. This is always done before an applicant moves into a property.
However, there are occasions when the applicant doesn't have the required documentation, so this needs to be referred to the Home Office to determine if they have the Right to Rent a property in England.
NEW RIGHT TO RENT CHECK PROCESS
During the lockdowns this year, a new system was set up for non-UK nationals to evidence their status to rent property digitally through the Home Office. It has been so effective that it will now be a permanent system via a video call.
Applicants will receive a code from the Home Office before entering the UK to share with agents. With this code, agents can access a real-time Home Office system, reducing delays in obtaining information from the Home Office when the Right to Rent check is carried out.
Agents will still need to complete their own Right to Rent checks to ensure complete security for clients, as not everyone will currently have an immigration status that can be verified online.
The system will also clearly display if any follow-up checks are needed and provide a record of the check for the agent to store.
The following individuals will require a digital check:

- Non-EEA nationals with a current biometric resident permit or card
- EEA nationals and their family members with status granted under the EU Settlement Scheme
- Those with status under the points-based immigration system
