Pure Town Planning- Won on appeal: advertisement consent for illuminated sign in New Milton, Hampshire

New Forest District Council: Dan Wilden has recently won an advertisement consent appeal against a refusal of advertisement consent by New Forest District Council.

Pure Town Planning recently secured a subsequent consent for a new illuminated sign on the gable end wall of a commercial property in New Milton town centre (report here). But the Council approved it subject to a condition requiring our client to paint the gable end wall of the building (on which the sign is to be situated) white – and keep it white whilst the sign was in place. Our client had previously painted the gable end wall black and, despite our client being quite within their rights, the Council were not keen on it.

 

Dan specifically asked the Inspector to consider granting consent for what is essentially the same sign but without the condition so the wall can remain black. The Inspector having visited the site was rather taken with the black-painted wall and felt that it added interest to the area as well as seeing other benefits in terms of long term appearance. The Inspector therefore was happy to grant consent for the sign without the requirement for painting the wall white first – much to the satisfaction of our client.
